Filing a DMCA Takedown Notice

Upon receiving a valid DMCA notice, we will promptly investigate the claim and take appropriate action, which may include removing or disabling access to the allegedly infringing material.

Counter-Notification Procedure

If you believe that material you posted on BuyingNerd was removed or disabled as a result of a mistake or misidentification, you may file a counter-notification. Your counter-notification must include the following:

1. Identification of the material — A description of the material that was removed or disabled and the location where it appeared before it was removed or disabled.
2. A statement under penalty of perjury — A statement, made under penalty of perjury, that you have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material.
3. Your contact information — Your full legal name, mailing address, telephone number, and email address.
4. Consent to jurisdiction — A statement that you consent to the jurisdiction of the federal court in your district (or, if you are outside the United States, any judicial district in which BuyingNerd may be found), and that you will accept service of process from the person who filed the original DMCA notice or an agent of such person.

Upon receiving a valid counter-notification, we will forward it to the original complainant. If the original complainant does not file a court action seeking to restrain the allegedly infringing activity within 10 business days, we may restore the removed material.

Repeat Infringers

BuyingNerd reserves the right to terminate access for users or contributors who are found to be repeat infringers of copyrighted material. We will act on this policy at our discretion and in appropriate circumstances.
